1. Company

This user agreement (“the Agreement”) contains the terms and conditions of the use of designshopoutlet.com web service (“the Service”) owned by pmbm DESIGN Ltd. (“Service Provider”). When a person (“the User”) completes the registration process or uses the Service or orders product/s, they agree to this Agreement.

The contents of the Service belong to the Service Provider.

2. Use of the Service

The Service is intended for private individuals, institutions and companies.

The return policy does not apply to orders made by institutions or companies.

Everything in the Service, including images, drawings, sound, graphics and text, is protected by the worldwide copyright and other proprietary laws and treaty provisions. The Service Provider grants you a limited license to access and make personal use of this site, and not to download, except where specifically invited, nor to duplicate, sell or modify, any portion of this site without an express written authorization from the Service Provider.

3. Registration

The User may register as a user by filling out the registration form and choosing a user name and a password. The user can also order products without registration. When completing the order, the User must fill in their first name, last name, delivery address, postal code, country, email and phone number. The institutional and corporate customers must include the trade registry number and VAT number.

The User has the right to examine, change and delete information about themselves from the register.

By ordering products, the User warrants that they have read the terms of this agreement, agree to these terms and pledge themselves to comply with these terms.

The User ordering on behalf of a company warrants that they have sufficient authority to order the items in question and to bind the/their company to this Agreement.

Registration is free of any charges.

4. User Responsibilities

The User accepts responsibility for all activities that occur under their account and password. The User is solely responsible for maintaining the security of their password.

The User warrants to the Service Provider that the information they provide during the registration process (and any notification of change of such information) is true and correct.

The User warrants that they are over 18 years old of age.

5. Privacy policy

The Service Provider is committed to respecting the User´s privacy and committed to handling the User information according to Law.
The User information will be saved to the customer register of the Service Provider. The Service Provider does not transfer any information given by the User for to a third party for any other purpose than processing the order.

The Information in the Customer Register may be used in direct electric advertising only with the permission of the User

The Service Provider reserves the right to transfer the information provided by the User to the authorities in the case of infringement of laws and violation of good practice by the User.

The User warrants using the Service according to Law and Good Manners. The User agrees not to send or deliver material at the Service that is against Law and Good manners, nor to provoke or advance such action.

The User is fully responsible for any abusive use of the Service and the possible harm thus caused to The Service, to the Provider, to other Users, and/or to Third Parties.

6. Ordering

A binding sales agreement between the User and the Service Provider has been reached when an order has been placed in the Service and the User has received an order confirmation by e-mail in which the availability and estimated delivery time are confirmed.

Unless otherwise agreed by the Service Provider, payment must be received by the Service Provider prior to acceptance of an order.

7. Product prices

The product price is the price displayed for the item on the Service at the time of ordering.

Delivery charges are added to the order and they are additional to the product price. Delivery charges vary according to the weight, volume and destination of the order.

Delivery charges are displayed on the “Shopping cart” page and should be noted before confirming the order.

All the product prices and delivery charges include 22% VAT according to Finnish Law.

Users outside the EU are responsible for any customs, duties and brokerage charge which may be imposed. These charges will be collected when the order is delivered.

All the product prices and delivery charges are displayed in euros (EUR).

8. Delivery

The User will receive the ordered products via a Third Party, based on the Delivery Agreement between the Service Provider and The Third Party.

Delivery charges are additional to the product price. Delivery charges may be seen on the “Shopping cart” page when placing the order.

Delivery times vary from product to product. The delivery time is determined by the availability of the product, and the order destination. The valid delivery method is displayed in the Service.

The Service Provider shall not be liable for delays in performing, or the failure to perform this Agreement, or any obligations hereunder, which are directly attributable to causes beyond its reasonable control (force majeur).

The Service Provider reserves the right to deliver separate products ordered simultaneously or separately.

The Service Provider takes responsibility over the loss and/or damage of the product during the delivery.

9. Cancellation and return of products

According to the Finnish consumer protection legislation the User (except institutions and companies) has a fourteen-day (14) right to return or exchange a product. This returns policy does not extend to products modeled or altered according to the customer’s wishes. Such products are clearly indicated as“Made-to-Order”, and confirmed in written format with customer.

The customer has a right to return a product if the order has been cancelled according to the terms and conditions by notifying DesignShopOutlet within 14 days of delivery. The product has to be unused and in the same condition the customer received it. All product parts must be included in the package, and the product has to be repackaged into its original package, or an equivalent.

The product must be returned immediately after cancellation.
When returning products the User will be responsible for the risk of damages.

10. Changes

The Service Provider reserves the right to make changes to the Service, policies, and this User Agreement at any time. The Service Provider reserves the right to make changes to the User Agreement solely by informing the User via the Service. The User accepts the changes by using the Service.

11. Settlement of disputes

This User Agreement will be interpreted, construed and enforced in all respects in accordance with the laws of the Republic of Finland. Any contractual disputes are primarily settled through negotiations, in other cases disputes are settled at the Espoo District Court, Finland.

12. Language

The parties have agreed that this Agreement and related documents shall be written in English.
